IMPORTANT NOTICE – INTERMEDIARY ROLE

tuktukSLR.com is a platform that offers information and a means to access transportation services provided by third-party Transportation Providers, including drivers or vehicle operators (“Transportation Provider”). By using the Website and/or the Service, users can connect with authorized Transportation Providers to request and fulfill transportation services.

For clarity, tuktukSLR itself does not provide transportation services and is neither a transportation service provider nor a carrier. The Website acts solely as an intermediary between the Renter and the Transportation Provider, facilitating their interactions. The provision of transportation services by the Transportation Provider to the Renter is governed by these Rental Terms. The Website and tuktukSLR are not parties to agreements formed between Transportation Providers and Renters.

Please read these Rental Terms carefully before using our Service. By booking with tuktukSLR, you acknowledge and agree to these terms.

1. Definitions and Interpretive Guidelines

1.1 In these Rental Terms, the following definitions apply:

  1. Accessory: Refers to any additional equipment provided with the tuktuk (e.g., phone holders, chargers, rain flaps, extra seat belts).
  2. Authorised Driver: Any additional driver approved for the rental who meets all legal and operational requirements (such as possessing a valid driver’s license or International Driving Permit, as applicable).
  3. Late Return Charge: Any fee imposed if the tuktuk is not returned by the agreed time (for example, US$40 plus any extra daily charges).
  4. Mechanical Standard Rate Sheet: A guide that lists pre-determined and fair prices for common repairs or part replacements should the vehicle sustain damage beyond ordinary wear and tear. The sheet is located here.
  5. Payment Processor: The secure service or platform (e.g., online payment gateway, bank transfer system) used to process all payments and transactions related to the rental.
  6. Renter: The person who makes the booking and is responsible for the safe operation and return of the tuktuk under these terms.
  7. Rental Charges: All fees, costs, and taxes shown on the Website at the time of booking, including the base rental fee, any added service charges, and applicable taxes.
  8. Rental Period: The duration of the rental agreement, commencing at the scheduled Pick-Up time and ending when the tuktuk is returned as agreed.
  9. Rental Terms: This entire contractual agreement between the Renter and the Transportation Provider, as facilitated by tuktukSLR.
  10. Security Deposit: A refundable sum collected at booking (currently US$150) to cover potential damages, late returns, cleaning fees, or loss of provided equipment.
  11. Substitute Vehicle Insurance: Additional or alternate insurance coverage is applicable if the Renter is issued a replacement vehicle under unforeseen circumstances.
  12. Underbody Damage: Damage affecting the lower parts of the tuktuk, including the chassis, axles, or any components beneath the vehicle, typically due to contact with uneven surfaces.
  13. Overhead Damage: Damage to the upper sections of the tuktuk (e.g., the roof or canopy) due to contact with low-hanging objects or obstacles.

1.2 Together with any documents referenced herein, these Rental Terms form the entire agreement between the Renter and the Transportation Provider. tuktukSLR, acting solely as an intermediary, does not become a party to the actual service agreement between the Renter and the Transportation Provider.

2. The Transportation Provider

2.1 The Transportation Provider confirms and agrees to the following:

  1. The Vehicle is registered for use on roads and will remain registered for the entire Rental Period.
  2. The Vehicle is fully insured, covering damages to the Vehicle and its occupants (provided the Vehicle is driven by a licensed driver).
  3. All essential components ( such as engine oil, brake fluid, and battery levels) meet the manufacturer’s specifications and are verified to be in proper condition prior to rental.
  4. At Pick-Up, the Vehicle is delivered with a minimum of 3 liters of fuel (petrol 92 octane).
  5. The Vehicle is roadworthy and free from any defects that could impair its safe operation or violate local laws, to the best of the Transportation Provider’s knowledge.

2.2 The Transportation Provider, either directly or through tuktukSLR, will:

  1. Make the Vehicle available at least 30 minutes before the scheduled Rental Period starts at the Pick-Up location agreed upon on the Website.
  2. Deliver the exact Vehicle specified in the booking, unless an alternative has been pre-approved in writing by the Renter.
  3. Hand over all necessary keys and accessories, ensuring the Vehicle’s proper operation.

2.3 If the Transportation Provider is unable to meet any of the above obligations ( from Sections 2 of 2.1 or 2.2 ), they must notify the Renter ( directly or through tuktukSLR.com) at least 48 hours prior to the scheduled start, allowing the Renter to make alternative arrangements.

2.4 During the Rental Period, the Transportation Provider shall:

  1. Refrain from interfering with the Vehicle’s use or route unless specifically and in writing requested by the Renter.
  2. Not contact the Renter with travel or tourism recommendations unless the Renter requests such assistance in writing.
  3. Provide responsive assistance for any Vehicle-related inquiries or issues if the Renter reaches out.
  4. Help the Renter with any necessary insurance claims or procedural matters related to incidents, to the best of their ability.

3. The Renter

3.1 The Renter agrees to the following responsibilities:

  1. Only the Renter or an Authorised Driver may operate the TukTuk during the Rental Period. Each Authorised Driver must meet all applicable legal and operational requirements, such as holding a valid national driver’s license,  an International Driving Permit where necessary.
  2. The tuktuk must be driven responsibly and in full compliance with all local and international traffic laws and safety regulations.
  3. The Renter is required to return the tuktuk in the same condition as received, except for normal, reasonable wear and tear.

3.2 The Renter acknowledges:

  1. Participation in activities such as adventure travel involves inherent risks and dangers, including accidents, personal and bodily injury (including death), and property loss or damage. The Renter agrees that they have considered the nature and extent of these risks and voluntarily choose to assume all such risks, both known and unknown, including those arising from the negligence of others. The Renter assumes full responsibility for their participation in such activities.
  2. While the tuktuk is insured for most scenarios during the Rental Period, the Renter must arrange their own international travel insurance to cover additional risks, such as personal medical expenses, liability, or unforeseen incidents.
  3. The Renter understands that tuktukSLR and the Transportation Provider are not liable for acts or omissions of third parties not connected with the provision of the rental service, especially those that are unforeseeable or unavoidable.

3.3 The Renter must:

  1. Perform regular checks of the Vehicle during the Rental Period (such as engine oil, brake fluid, and battery condition) and, where needed, add approximately 100 ml of engine oil for every 1,000 kilometers traveled.
  2. Immediately report any incidents, malfunctions, or damage to tuktukSLR or the Transportation Provider.
  3. Avoid using the tuktuk for any prohibited purposes, including off-road driving, towing, racing, or operating the Vehicle under the influence of alcohol or drugs (the legal limit is 0.00%).

4. Permitted Routes and Operational Zones

4.1 The tuktuk is to be driven only on approved roads (sealed, metalled, or gravel) within Sri Lanka. 

4.2 The Renter must ensure that the tuktuk is not driven off-road (e.g., on fire trails, beaches, or grassy fields) or in any manner that breaches local laws or endangers safety. 

4.3 Use for activities such as racing or towing, or any use that could compromise the integrity of the tuktuk, is strictly prohibited.

5. Use of the Vehicle

5.1 During the Rental Period, the Renter agrees to:

  1. Conduct basic daily inspections of the Vehicle’s essential systems (fuel, engine oil, brake fluid, battery, etc.).
  2. Refill engine oil as necessary (typically about 100 ml per 1,000 km) to maintain proper operation.
  3. Grease the Vehicle as required every 1,000 km. (If this maintenance is not done at an authorized service center, any resulting costs—estimated between LKR 3,000 and LKR 4,000—will be charged to the Renter.)
  4. Keep the tuktuk clean and return it in the same state as received (aside from normal use). A cleaning fee (up to LKR 1,000) may be imposed if the Vehicle is returned excessively dirty.
  5. Avoid overloading the Vehicle and ensure that the maximum passenger capacity is not exceeded.
  6. Not use, or allow the Vehicle to be used, for any illegal purpose, race, contest, or performance test of any kind unless explicitly agreed upon with the Transportation Provider in writing.
  7. Not, without the Transportation Provider’s prior written consent (either directly or indirectly through tuktukSLR), use or allow the Vehicle to be used to push or tow anything.
  8. Do not operate the Vehicle while under the influence of alcohol, drugs, or with a blood alcohol content exceeding the legal limit in the country of rental.
  9. Do not use the Vehicle if it is damaged or unsafe.
  10. Avoid driving the Vehicle after an accident or collision (including hitting an object or animal) until approval is obtained from the Transportation Provider (either directly or indirectly through tuktukSLR).
  11. Not without the Transportation Provider’s prior written consent (either directly or indirectly through tuktukSLR), use the Vehicle to carry any flammable substance with a flash point under 22.8°C or any other explosive or corrosive materials.
  12. Do not use the Vehicle in violation of any local or international laws.
  13. Do not place items on the roof of the Vehicle unless it is equipped with roof racks. Roof racks may only be used to carry luggage, and the Renter must not sit, stand, or allow others to sit or stand on the roof.
  14. Do not exceed the speed limit while driving the Vehicle.
  15. Comply with all local and international laws governing the use and operation of the Vehicle.
  16. Reimburse the Transportation Provider (either directly or indirectly through tuktukSLR) for any items or accessories lost, stolen, or replaced with lower-quality items during the Rental Period.

5.2 The Renter agrees not to:

  1. Use the tuktuk for driving under the influence of alcohol or drugs (with the legal limit being 0.00%).
  2. Operate the Vehicle for any unlawful or unsafe purposes.

5.3 The Renter must pay all parking fees, speeding fines, traffic infringements, and tolls incurred during the Rental Period.

6. Maintenance, Security, and Safety

6.1 The Renter must:

  1. Always lock the tuktuk and keep the keys secure when the vehicle is unattended.
  2. Immediately notify tuktukSLR or the Transportation Provider of any issues, incidents, or damage incurred during the Rental Period.

6.2 The Transportation Provider is responsible for repairs arising from normal wear and inherent mechanical faults.

However, if damage is caused by negligence, misuse, or unauthorized modifications by the Renter, such repair costs will be charged according to the Mechanical Standard Rate Sheet.

6.3 The Renter must not authorize or perform any repairs without prior written consent from the Transportation Provider or tuktukSLR 

And must provide original receipts or invoices for any repair reimbursements that might be applicable.

7. Pick-Up, Inspection, and Return

7.1 Pick-Up Process:

  1. Upon arrival in Sri Lanka, the Renter will meet with tuktukSLR staff at the designated Pick-Up location (e.g., our head office in Wadduwa or another agreed site, such as the airport, hotel).
  2. The Renter must complete a complimentary 60-minute local driving lesson, covering basic operation, maintenance, and safety guidelines. A digital inspection (approximately 15 minutes) will also be conducted to document the condition of the tuktuk at the start of the Rental Period.
  3. All keys, documents, and provided accessories (e.g., phone holders, chargers) will be handed over at this time.

7.2 Return Process:

  1. The Renter must return the tuktuk to the Transportation Provider at the agreed location, on the date, and by the time specified in the booking. If the Renter wishes to make changes to the return details, they must inform the Transportation Provider (either directly or indirectly through tuktukSLR) prior to the return date, and the Transportation Provider must agree to the changes.
  2. The tuktuk must be returned in the same condition as received at the commencement of the Rental Period, allowing for fair wear and tear, and with the same fuel level as recorded at Pick-Up.
  3. A final inspection will be carried out to verify the condition of the tuktuk.
  4. Late returns of up to 2 hours incur no additional fee; returns beyond 2 hours will trigger additional charges, including the Late Return Charge.
  5. If the Renter returns the tuktuk on a date, time, or to a location other than that directed by the Transportation Provider, a ‘one-way fee’ of up to $2 per kilometer may be charged to return the tuktuk to the original return location. Additional Rental Charges may also apply.

7.3 Early Drop-Off: If the Renter wishes to return the tuktuk earlier than the scheduled end of the Rental Period, the following conditions apply:

  1. Notification MORE than 3 days in advance: A 1-day rental fee will be charged for the next 1 day after the drop-off date. The remaining balance will be fully refunded.
  2. Notification LESS than 3 days in advance: A 2-day rental fee will be charged from the drop-off date. The Renter will receive a 50% refund for the remaining days.

These charges help maintain fairness to local vehicle owners who rely on income from their tuktuks. Advance notice allows better management of bookings and ensures a smooth experience for all parties involved.

7.4 Immediate Return Requests: The Transportation Provider (either directly or indirectly through tuktukSLR) may request the immediate return of the tuktuk or recover the tuktuk without notice if:

  1. The credit limit on the Renter’s payment method would be exceeded by debiting Rental Charges for an extension or a ‘one-way fee.’
  2. The Rental Period expires without satisfactory arrangements made by the Renter with the Transportation Provider.
  3. The Transportation Provider reasonably suspects that:
    1. The tuktuk may be used for unlawful purposes.
    2. Damage to the tuktuk or injury to persons or property is likely to occur.
    3. The tuktuk may be involved in an industrial dispute.

7.5 Failure to Return the tuktuk: 

If the Renter does not return the tuktuk on the agreed date and time (or any extended date or time approved by the Transportation Provider):

  1. After written notice to the Renter (either directly or indirectly through tuktukSLR), and if the location of the tuktuk is unknown, the Transportation Provider may report the tuktuk as stolen to the police.
  2. The Renter must pay all Rental Charges (including additional charges) and compensate the Transportation Provider for any losses incurred, including reasonable costs for recovering the tuktuk, up to the time it is recovered in the same condition as at the start of the Rental Period, allowing for fair wear and tear.

8. Fuel Management and Refueling Policy

8.1 The tuktuk must be returned with the same fuel level as provided at Pick-Up. 

8.2 Should the fuel level be found lower upon return, the Renter agrees to pay for the additional fuel required to reach the original level. 

8.3 Fuel levels will be verified via visual inspection of the fuel gauge and documented by the inspection process.

9. Loss Damage Waiver, Damage, and Loss of Property

9.1 The Renter is fully responsible for any loss or damage to the tuktuk during the Rental Period, including damage to third-party property caused by the Renter or any Authorised Driver. 

9.2 The Renter’s financial liability for incidental or minor damage is capped at US$200. Any damage exceeding this cap due to accidents, negligence, or intentional actions will be charged to the Renter. 

9.3 The Renter is also accountable for any loss or theft of keys or accessories provided with the tuktuk. 

9.4 In the event of an incident, additional daily fees of US$10 may be imposed to cover rental downtime and any loss of income suffered by the local Transportation Provider.

10. Incident Reporting and Dispute Resolution Procedures

10.1 In the event of an accident or Incident, the Renter must:

  1. Immediately contact the local authorities and obtain a police report if required by law.
  2. Notify tuktukSLR as soon as possible and provide all relevant information, including names, contact details, and photographs of any damage incurred.
  3. Refrain from making any admissions of liability or settling claims without prior consultation with tuktukSLR.

10.2 For minor incidents (i.e., damage up to US$200 with no injuries), the parties may negotiate a settlement under the guidance of tuktukSLR. For more significant events, formal insurance claims will be processed in accordance with the established procedures.

11. Pricing, Payment Processes, and Deposit Handling

11.1 Rental Charges:

  1. All fees are listed in US Dollars (USD) unless otherwise noted. Rental Charges are determined based on the duration and terms agreed upon at the time of booking.

11.2 Payment Methods:

  1. Cash: Accepted at Pick-Up in major currencies (LKR, USD, Euro, GBP).
  2. Online: Payments are processed via our secure Payment Processor.
  3. Bank Transfer: Rental fees may also be settled through bank transfer as specified during booking.

11.3 Security Deposit:

  1. A refundable deposit of US$150 is collected at booking. This deposit will be returned following the final inspection of the tuktuk, minus any deductions for damage, cleaning, or extra usage fees.

11.4 Any outstanding charges not settled within 14 days may incur interest at 10% per annum (compounded daily) along with any applicable administrative or collection fees.

12. Cancellation, Early Drop-Off, and Termination

12.1 Cancellation Policy:

  1. More than 30 days prior to the Rental Period: Full refund, including Security Deposit.
  2. Between 30 and 15 days prior: 50% refund, with necessary deductions for licensing or administrative costs.
  3. Between 15 and 7 days prior: 25% refund (deposit is returned less any incurred fees).
  4. Less than 7 days before the Rental Period: No refund will be provided.

12.2 Early Drop-Off:

  1. If returning the TukTuk before the agreed end, a fee will apply: notice given more than 3 days in advance incurs a fee of one day’s rental; notice given less than 3 days in advance incurs a fee of two days’ rental.

12.3 Termination:

  1. Either party may terminate this agreement immediately in the event of a material breach of these Rental Terms. If the tuktuk is not returned as agreed, tuktukSLR reserves the right to pursue all available remedies, including reporting the Vehicle as missing.

13. Force Majeure and Unforeseeable Circumstances

13.1 tuktukSLR shall not be responsible for any delays or failures in service resulting from events beyond its control, such as natural disasters, strikes, terrorism, or government actions (collectively “Force Majeure”). 

13.2 In such cases, the Rental Period may be extended or alternative arrangements offered; however, the Renter remains responsible for any charges incurred for services rendered prior to the event.

14. Property Left in the Vehicle

14.1 tuktukSLR and the Transportation Providers are not liable for any personal property left in or on the tuktuk, except where negligence or fraud can be substantiated. The Renter is responsible for securing all personal belongings during the Rental Period.

15. Risks, Liability Limitations, and Waiver of Claims

15.1 The Renter acknowledges that operating a tuktuk in Sri Lanka involves inherent risks, including potential accidents, personal injury, or property damage. 

15.2 By accepting these Rental Terms, the Renter waives any claims against tuktukSLR and the Transportation Provider for any damages or injuries that are not directly attributable to their negligence.

16. Amendments, Updates, and Concluding Provisions

16.1 The English version of these Rental Terms is the sole authoritative document. In the event of any translation discrepancies, the English version shall prevail. 

16.2 tuktukSLR reserves the right to modify these terms at any time. Updated terms will be posted on the Website and will apply to bookings made after the effective date of such changes. 

16.3 Any waiver or modification of these terms must be in writing and signed by an authorized representative of tuktukSLR and the affected party.

17. Agreement Declaration

By confirming your booking on tuktukSLR.com, you acknowledge that you have read, understood, and agreed to abide by these Rental Terms & Conditions in their entirety.
